It\u2019s the most common private renting issue. Many tenants \u2014 across all renting tenures \u2014 struggle to get basic repairs carried out, and find it difficult to make progress if their landlord doesn\u2019t cooperate.<\/p>\n<p id=\"1518\" class=\"graf graf--p graf-after--p\"><strong class=\"markup--strong markup--p-strong\">The government have announced a new scheme for improving repairs<\/strong><\/p>\n<p id=\"b42b\" class=\"graf graf--p graf-after--p\">At the Conservative party conference, the Secretary of State for Communities and Local Government announced that it will be compulsory for private rented sector landlords to sign up to a redress scheme. These are free, mandatory and independent ways to raise complaints without going to court, also known as Alternative Dispute Resolution (ADR).<\/p>\n<h3 id=\"1fad\" class=\"graf graf--h3 graf-after--p\"><strong class=\"markup--strong markup--h3-strong\">Getting repairs done is too difficult for many\u00a0tenants<\/strong><\/h3>\n<p id=\"4b1f\" class=\"graf graf--p graf-after--h3\"><a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/www.citizensadvice.org.uk\/about-us\/policy\/policy-research-topics\/housing-policy-research\/its-broke-lets-fix-it\/\" target=\"_blank\" rel=\"noopener\" data-href=\"https:\/\/www.citizensadvice.org.uk\/about-us\/policy\/policy-research-topics\/housing-policy-research\/its-broke-lets-fix-it\/\">Our recent report<\/a>\u00a0looked at how the government could improve private renters\u2019 access to repairs and compensation. We surveyed tenants and advisers, and carried out interviews with Citizens Advice clients who had faced problems.<\/p>\n<p id=\"8b43\" class=\"graf graf--p graf-after--p\">Our research found that very few tenants feel able to take the complex, lengthy and often costly steps involved with court-based redress or local authority routes.<\/p>\n<figure id=\"35ce\" class=\"graf graf--figure graf-after--p\">\n<div class=\"aspectRatioPlaceholder is-locked\">\n<div class=\"aspectRatioPlaceholder-fill\"><\/div>\n<div class=\"progressiveMedia js-progressiveMedia graf-image is-canvasLoaded is-imageLoaded\" data-image-id=\"0*4AaIEO24VihjKeVx.\" data-width=\"865\" data-height=\"489\" data-action=\"zoom\" data-action-value=\"0*4AaIEO24VihjKeVx.\" data-scroll=\"native\"><canvas class=\"progressiveMedia-canvas js-progressiveMedia-canvas\" width=\"75\" height=\"40\"><\/canvas><img decoding=\"async\" class=\"progressiveMedia-image js-progressiveMedia-image\" src=\"https:\/\/cdn-images-1.medium.com\/max\/800\/0*4AaIEO24VihjKeVx.\" data-src=\"https:\/\/cdn-images-1.medium.com\/max\/800\/0*4AaIEO24VihjKeVx.\" \/><\/div>\n<\/div>\n<\/figure>\n<p id=\"d720\" class=\"graf graf--p graf-after--figure\">Tenants are much more likely to try other things: fixing it themselves, withholding rent, moving house. Many simply put up with the problem.<\/p>\n<h3 id=\"fbff\" class=\"graf graf--h3 graf-after--p\"><strong class=\"markup--strong markup--h3-strong\">How to design a redress system that\u00a0works<\/strong><\/h3>\n<p id=\"ce84\" class=\"graf graf--p graf-after--h3\">It\u2019s clear that the current system for resolving complaints isn\u2019t working. For that reason, we welcome the Secretary of State\u2019s plans to introduce a free, mandatory and independent way for tenants to raise complaints about disrepair without going to court<strong class=\"markup--strong markup--p-strong\">.\u00a0<\/strong>But as\u00a0<a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/www.citizensadvice.org.uk\/about-us\/policy\/policy-research-topics\/consumer-policy-research\/consumer-policy-research\/confusion-gaps-and-overlaps\/\" target=\"_blank\" rel=\"noopener\" data-href=\"https:\/\/www.citizensadvice.org.uk\/about-us\/policy\/policy-research-topics\/consumer-policy-research\/consumer-policy-research\/confusion-gaps-and-overlaps\/\">our wider work on alternative dispute resolution<\/a>\u00a0shows, not all redress schemes are created equal.<\/p>\n<p id=\"45ab\" class=\"graf graf--p graf-after--p\">Here are three key things the government needs to consider:<\/p>\n<h4 id=\"dec1\" class=\"graf graf--h4 graf-after--p\"><strong class=\"markup--strong markup--h4-strong\">1. Protecting tenants from\u00a0eviction<\/strong><\/h4>\n<p id=\"9460\" class=\"graf graf--p graf-after--h4\">It is vital that the government protects tenants who raise complaints. Our research found that fear of eviction is the most common reason for avoiding making a formal complaint. These fears can be well founded. Jo, who we interviewed, was evicted soon after complaining to her council about multiple disrepair issues that resulted in a chest infection and electrocution. Tenants should know that while their complaint is being considered by the redress scheme, they cannot be evicted. They should also know that, if their complaint is upheld, they will continue to be protected.<\/p>\n<h4 id=\"5871\" class=\"graf graf--h4 graf-after--p\"><strong class=\"markup--strong markup--h4-strong\">2. Removing costs to\u00a0tenants<\/strong><\/h4>\n<p id=\"d5cc\" class=\"graf graf--p graf-after--h4\">For a redress scheme to work well, it has to be free for tenants to use. The tenants we surveyed said the biggest barrier to going to court was the cost. The potential cost of court can be particularly worrying if the tenant is already out of pocket because of disrepair. We interviewed Shafeeq, who paid more than \u00a310,000 towards essential repairs and has struggled to cope with the court process. Our work on alternative dispute resolution shows many consumers wouldn\u2019t use redress schemes if they come with a cost.<\/p>\n<h4 id=\"14ed\" class=\"graf graf--h4 graf-after--p\"><strong class=\"markup--strong markup--h4-strong\">3. Expertise and power to\u00a0act<\/strong><\/h4>\n<p id=\"b5bf\" class=\"graf graf--p graf-after--h4\">Adjudicators in any redress scheme need to have enough expertise to make decisions on difficult issues. They also need suitable powers to take decisions that can be enforced quickly if a landlord fails to carry out repairs. This issue emerged in our research on ADR across consumer markets. It can be difficult for consumers to know what to do next if the business \u2014 or in this case landlord \u2014 refuses to participate or abide by the redress scheme\u2019s decision. Ensuring this part of the process works effectively, for instance through penalties for not participating or rapid escalations to court where necessary, is key to effective redress.<\/p>\n<h3 id=\"50a2\" class=\"graf graf--h3 graf-after--p\"><strong class=\"markup--strong markup--h3-strong\">The government needs to protect tenants living in unsafe\u00a0homes<\/strong><\/h3>\n<p id=\"4d67\" class=\"graf graf--p graf-after--h3\">Well designed redress schemes are important, but they aren\u2019t right for all repairs disputes. They aren\u2019t intended to tackle more complex health and safety issues, which is where the courts step in. Part of the government\u2019s announcements included consulting on a specialist housing court to save time and costs. It\u2019s vital these changes don\u2019t leave tenants without legal support in the name of cost-saving.<\/p>\n<p id=\"8cbf\" class=\"graf graf--p graf-after--p\">Redress schemes will make the private renting market more effective, making it quicker and easier for tenants to resolve problems. But there\u2019s more the government should do to address the worst health and safety problems.<\/p>\n<ul class=\"postList\">\n<li id=\"0824\" class=\"graf graf--li graf-after--p\">Firstly, the government should support the\u00a0<a class=\"markup--anchor markup--li-anchor\" href=\"https:\/\/services.parliament.uk\/bills\/2017-19\/homesfitnessforhumanhabitationandliabilityforhousingstandards.html\" target=\"_blank\" rel=\"noopener\" data-href=\"https:\/\/services.parliament.uk\/bills\/2017-19\/homesfitnessforhumanhabitationandliabilityforhousingstandards.html\">private member\u2019s bill on Fitness for Human Habitation<\/a>. This bill outlines a clear, simple and enforceable minimum standard for all rented housing \u2014 both social and rented \u2014 something which doesn\u2019t currently exist.<\/li>\n<li id=\"5fe0\" class=\"graf graf--li graf-after--li\">Secondly, there\u2019s currently no simple way to leave an unsafe home. Too often, tenants are forced to choose between living in a poor quality home and paying to leave the tenancy early, even when their landlord is acting unlawfully. Renters should have the right to leave their tenancy in these situations, without penalty.<\/li>\n<\/ul>\n<p id=\"b14a\" class=\"graf graf--p graf-after--li\">An independent, free and compulsory scheme to resolve disputes will make life easier for millions of private renters struggling with disrepair. But the government shouldn\u2019t stop there. Legislation will be needed to introduce a mandatory redress scheme.
